It’s very simple. KIT radio is in danger of violating federal law. That’s pretty serious.

The answer. Dave Ettl should stay off the air while he’s running.

    No question Ettl needs to go off the air while he is running for office, unless his employer is willing to give equal time to both his primary opponents. If going off the air creates a problem with his employer or a financial hardship for him, he should of thought of that before he filed. Most candidates check with their employers before they file – so if he had that conversation with his employer, did they not know about “equal time” or did they think they could just bully the other candidates and leave him on the air in clear violation of federal law? Heads up Yakima – don’t think Ettl will become a kinder, gentler concerned council person working in the interest of city govt – it’s all about Bully Boy Dave.

    I suggest KIT invite Dave’s Ms. Rodriguez to join him in the air each day. Give her a mic and headset and let her be part of each show. It gives her equal time and I am sure it will show the listening audience who is qualified to fill the seat. Think about it. Sonja would have to speak. She would have to comment on issues.
    Lets see how much equal time means to her if she has to get up at 4am each day. C’mon KIT, it is the perfect solution :)

    Since when does “equal time” mean “same time”? And wouldn’t KIT have to pay her the same rate she bills her clients since Ettl would be getting paid while he is on the air? And aren’t you forgetting about the other candidate? I guarantee if all three candidates talk 3-4 hours a day, the listening audience will soon be signing off! A perfect solution, eh? I think not.

    — Hello Seagal…No question Ettl needs to go off the air while he is running for office unless his employer is willing to give equal time to both his primary opponents. ***With all due respect, that’s not quite true Seagal, the FCC doesn’t mandate that an on-air candidate go off air …only that an arrangement be made with ALL other candidates…that could include minute for minute of “equal time” if both the candidate and the broadcast station agree…other options are up to the negotiating parties.

This is a “big story” to the paper, not to us..to me it is part of the expected, naturally unfolding story of my campaign as an on air host.

We discussed it at length and spoke a number of times with the Washington State Association of Broadcasters and with representatives of the F.C.C. as well as with our Gap West home office and our broadcast attorneys. Most on air hosts come off air to avoid the hassle or the expense of equal time. I hope to be able to avoid that by working with Gap West to offer a targeted program that will actually help the opposition’s campaign. The radio station wants me on air for their purposes, not my political interests … they don’t endorse candidates and only want a full and open debate which is why they are willing to offer such generous compromise. The bottom line is–keeping me on air NOT talking politics is GOOD for KIT–offering my opponents focused generous media in a more manageable form is BETTER for their campaigns than a huge block of “equal time” which would prove to be overkill and ultimately counter-productive.

If the opposition chose not to request equal time, it wouldn’t be a violation of any kind. The F.C.C. says it’s there to be made available only “IF” requested.
    If the opposition requests equal time we are authorized to negotiate a more workable arrangement…and any compromise is only as good as the opposition says it’s good and they may change their minds later on. Or the opposition my not want to compromise and may feel their campaigns are better served by me coming off the air –which is probably what a full request of equal time would accomplish…in which case, I come off air as I am now during the negotiating phase. Your assumption of “bullying” is totally unfounded and unfair. Ask Sonia Rodriguez, our offer was very reasonable, she has countered and we are in discussion, we hope to start that same fair process with Sharon Madson tomorrow.
    Your post seeks to paint me as an uninformed bully. The only bullying here is in your uninformed approach to a post that attempts to misrepresent me and my employer’s efforts to make a fair and legally authorized counterproposal….and isn’t that part of what good government is all about?

    Over here on the Wet Side, a very prominent radio host, Dave Ross, ran for Congress. He did not win, but for the duration of the election, he stepped down from his job at KIRO radio because it was the right thing to do.

    The only fair way to do this is for Ettl to take a leave from the air while running for a public office. He’s getting free political advertising any way he spins this, even though he says he will not be discussing politics during the campaign. Voters will tune in to hear the candidate on his radio show, and Dave gets name recognition for that, which is exactly what he wants. If Ettl stays on the air, the station needs to give the two opposing candidates their own shows as well. Since that is not likely to happen, Dave needs to resign.

    It’s painfully obvious none of the naysaying posters in here have read the federal law (section 315) pertaining to “equal time”, or they wouldn’t have said some of the inane things they did.

    Seagal referring to it as a “clear violation of federal law”? It’s such a clear law, it’s been challenged to interpret in Federal court on several occasions. I challenge you to read the law and call it “clear”.

    As to paying Sonia Rodriguez the same rate she bills her clients?
    Not a chance. By law, she gets airtime at the same rate Dave would…free. That’s all. She doesn’t “get her own show”, as Dave doesn’t have his. She gets the same amount of minutes on air that Dave uses. That would also include any voice-over work he does on commercial advertising. As close as I can read, only the minutes Dave is talking count. Lance talking doesn’t.

    Interestingly enough, if this were a partisan race, and both Dave’s opponents were of the opposite party, Section 315 wouldn’t apply up to the primary, as neither candidate is Dave’s opponent yet. It would apply between then and the general election. Here’s a link.

    Corie’s comment about a KIRO guy leaving the air being the “right thing to do”? It was the cheap, expedient thing to do. Right had nothing to do with it.

    Drew’s comment about Dave resigning? He doesn’t legally have to resign. It’s all about air time.

    And, because Dave has so much name recognition in this area already, any airtime they offer to the other opponents would seem to be a gift horse to them. If I were them, I’d take it.

    By the way, Seagal…what is Sonia’s hourly rate? I can’t remember a successful attorney ever running for Yakima City Council. Probably because they are too busy. As much as she loves to make headlines in the paper, you’d think she needs the advertising. Nice of the YHR to oblige her.

    Yes, I do have a “dog in the fight”. And since when do either you or anybody dictate who can comment on what, and when?     kneel- (name spelled correctly), I do know what town I vote in. I also know unethical behavior in politics when I see it, as do a lot of other folks. The people in Yakima are not pleased with your good ol’ boy system of the conservative status quo, but you seem to be ok with it, since you aren’t talking about it. Why is that? Is Bruce Smith pulling your strings too? If so, then kneel is a good name for you.

    Ettl can stay on the air and get free advertising everyday, even if he doesn’t make a single political comment. It’s name recognition, and Dave is going to exploit it. Of course we expect his employer to leave everything in place- one of the hallmarks of the Good ol’ Boy system is that you leave everything in place, because it has worked so well for you so far.
    Bruce Smith is a great example of a political system that you do not want to see go away, and progressives like Rodriguez are a serious threat to that.

    Ettl has been on the air in Yakima for 25 years. Do you think he is staying on the radio now just for name recognition? He already has that. BTW have you listened to KIT the last few days? It sounds like Rodriguez and that other lady are the ones getting a butt-load of “free advertising”. Note to libs. I’m not crying about it, I guess that’s the agreement, and if they all signed off on it then this thread should be over.
